SINPO TERMS OF SERVICE (USER AGREEMENT)

These Terms of Service ("Terms") form a legally binding agreement between you and Sinpo Team ("Sinpo," "we," "us," or "our") governing your access to and use of the Sinpo mobile application and related services (collectively, the "Service").

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO THESE TERMS.

1) WHO WE ARE

2) ELIGIBILITY (17+)
The Service is intended for users age 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.

3) PRIVACY
Your use of the Service is also subject to our Privacy Policy, which explains how we collect and use information. Please review the Privacy Policy before using the Service.

4) ACCOUNT REGISTRATION AND SECURITY
To use certain features, you may need to create an account. You agree to:
- Provide accurate and up-to-date information (such as username and email).
- Maintain the security of your account credentials.
- Notify us promptly if you suspect unauthorized access to your account.

You are responsible for all activities that occur under your account.

5) THE SERVICE AND YOUR CONTENT
Sinpo is a dance video community app where you can record and share dance videos, discover choreography, and connect with dancers worldwide.

5.1) Your Content
"User Content" includes videos, photos, audio, text, comments, messages, and other materials you submit, post, or share through the Service. You retain ownership of your User Content.

5.2) License you grant to Sinpo
To operate and improve the Service, you grant Sinpo a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting/technical processing), publish, display, distribute, and perform your User Content in connection with operating, providing, and promoting the Service. This license ends when your User Content is deleted from the Service, except to the extent your content has been shared with others and they have not deleted it, or where retention is required by law.

5.3) You are responsible for your User Content
You represent and warrant that:
- You have the necessary rights to post the User Content.
- Your User Content and your use of the Service do not violate any laws or third-party rights (including intellectual property, privacy, or publicity rights).

6) COMMUNITY RULES AND PROHIBITED CONDUCT
You agree not to:
- Use the Service for illegal activities or to violate any applicable laws.
- Post content that is hateful, harassing, threatening, sexually exploitative, or otherwise harmful.
- Post content that infringes copyright, trademark, or other intellectual property rights.
- Impersonate others or misrepresent your affiliation.
- Attempt to gain unauthorized access to the Service or other users' accounts.
- Interfere with or disrupt the Service, including by introducing malware or abusive automated behavior.

We may remove content or restrict accounts that violate these Terms or our policies.

7) INTELLECTUAL PROPERTY
The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by Sinpo or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except as expressly permitted by us.

8) FEEDBACK
If you provide suggestions or feedback, you grant Sinpo the right to use it without restriction or compensation to you.

9) TERMINATION
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, pose a risk to the Service or other users, or as required by law. Upon termination, your right to use the Service will cease.

10) DISCLAIMERS
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SINPO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SINPO DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SINPO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT WILL SINPO'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SINPO FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12) INDEMNIFICATION
You agree to indemnify and hold harmless Sinpo Team from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms.

13) GOVERNING LAW
These Terms are governed by the laws of Sinpo Team's principal place of business, without regard to conflict of law principles, except where prohibited by applicable law.

14) DISPUTE RESOLUTION AND BINDING ARBITRATION
Please read this section carefully. It affects your legal rights.

14.1) Informal resolution
Before starting a formal proceeding, you agree to contact us at thanthile332@outlook.com and provide a brief description of the issue and your contact information. We will try to resolve disputes informally.

14.2) Binding arbitration
If a dispute cannot be resolved informally, you and Sinpo agree to resolve any dispute arising out of or relating to these Terms or the Service through binding arbitration, on an individual basis. Class actions, class arbitrations, and representative actions are not permitted.

The arbitration will be administered by a reputable arbitration institution, under its applicable rules, and conducted in English, unless the parties agree otherwise.

14.3) Exceptions
Either party may bring a claim in small claims court if it qualifies, or seek injunctive or other equitable relief for alleged infringement or misuse of intellectual property rights.

15) CHANGES TO THESE TERMS
We may update these Terms from time to time. We will update the "Last Updated" date above and, where required, provide additional notice. By continuing to use the Service after the updated Terms become effective, you agree to the updated Terms.
